Department for Promotion of Competition
Department for Promotion of Competition conducts activities for the benefit of promoting competition and counteracting negative results of natural monopoles, including the elaboration for practical standards for realization of the right to choose the supplier, monitoring the operation of the gaseous fuel and energy markets as well as energy companies from the point of abusing dominant position and behaviour contrary to competition practice and also cooperates with appropriate bodies in counteracting energy enterprises practices, which limit competition.
Moreover, the Department realizes tasks in the frame of:
- solving disputes concerning services based on transmission of gaseous fuels or electricity, storing gaseous fuels, transport of natural gas through the network of mining pipelines, liquefying and re-gasification of liquefied natural gas as well as proceedings for temporary exemption from the duty to provide these services, limiting it or exempting from providing it in relation to, so called, new infrastructure,
- realization of the duties resulting from the provisions of the Regulation 1228/2003/WE as well as 1775/2005/WE,
- approving grid code in the frame of balancing system and congestion managaments,
- monitoring the operation of gas and energy systems in the frame of fulfilling duties by the transmission and distribution system operators, with the reference to trans-border energy exchange and conditions for the access to natural gas transmission network,
- controlling of companies carrying out their activity in the frame of natural gas trading with abroad, or entities importing natural gas from abroad, as well as companies conducting their activities in the frame of storing natural gas, in the scope of the obligation to maintain required by law natural gas reserves,
- realization of the tasks of the ERO President connected with the liquidation of long-term capacity and power purchase agreements in power industry,
- monitoring and estimating the security for delivering gaseous fuels and electricity,
- organizing and carrying out tenders concerning the selection of suppliers ex officio as well as building new production capacity for energy and the realization of ventures lowering the demand for electricity,
- collecting and processing data concerning energy industry,
- collecting information about investment projects being in the scope of interest of the European Union and handing them over to the European Commission,
- transferring information to the European Commission concerning the amount of electricity imported from countries not being members of the European Union,
- publishing information serving the purpose of increasing the efficiency in fuel and electricity consumption,
- preparing applications to the European Commission concerning the statement, that the energy enterprise dealing with creation of networks intended to provide services connected with production, transmission or distribution of electricity, gas or heat or providing electricity, gas or heat to such networks or managing such networks, carries out activity on the competitive market.
