Exemption from the obligation to submit for approval tariffs with respect to trade in gaseous fuels on the wholesale natural gas market

The President of the Energy Regulatory Office informs that all energy companies licensed to trade in gaseous fuels may after submitting a motion, be exempted from the obligation to submit for approval tariffs for trading in gaseous fuels in the scope of its sale to the energy companies, which buy it under their gaseous fuels trading activity.

Assessing the effects of actions undertaken hitherto in order to introduce competition into the gas market, President of the Energy Regulatory Office found that the wholesale natural gas market, understood as the sale of natural gas to other entities for further resale, meets the conditions allowing to acknowledge this market as a competitive one. Therefore, with regard to this part of the gas market, maintaining the obligation to submit tariffs for approval may limit further increase of the wholesale market liquidity.

At the same time the regulator underlines that the exemption from the obligation to submit tariffs for approval does not imply an exemption from the application of the tariff that a company already holds.

The decisions on the exemption would be issued individually to all energy companies that carry out activity related to gaseous fuels trading, on the motion of the energy company.
